Distance Sales Agreement

This Distance Sales Agreement (“Agreement”) is entered into between the Seller, whose details are provided below, and the Buyer who purchases services electronically, in accordance with the Turkish Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

Buyer (Consumer):

A real or legal person who purchases services through the website.

SUBJECT OF THE AGREEMENT

The subject of this Agreement is the sale of the boat rental / yacht charter service ordered electronically by the Buyer through the website www.buenoways.com, and the determination of the rights and obligations of the parties in relation to such service.

SERVICE INFORMATION

The type, duration, start and end dates, yacht name, capacity, service price, payment method, and other details of the service are specified on the reservation/offer screens presented to the Buyer prior to payment and on the payment confirmation page, and constitute an integral part of this Agreement.

SERVICE PRICE AND PAYMENT

The service price is determined based on the yacht selected by the Buyer, the dates, and the scope of the service.

Payment may be made by:

– credit card,

– debit card,

– deposit (advance payment), or

– full advance payment.

Payment transactions are carried out securely through authorized payment service providers.

RIGHT OF WITHDRAWAL

Pursuant to Article 15 of the Regulation on Distance Contracts;

For services that must be provided on a specific date or during a specific period, including accommodation, transportation, vehicle rental, and leisure activities for entertainment or recreation purposes, the consumer does not have the right of withdrawal.

Since yacht charter services are date-specific and reservation-based services, the Buyer does not have a 14-day right of withdrawal.

CANCELLATION AND REFUND CONDITIONS

Cancellation, refund, and modification conditions are specified in the Cancellation & Refund Policy published by the Seller on a separate page.

The Buyer declares that they have read and accepted these conditions before completing the payment

PERFORMANCE OF THE SERVICE

The Seller is obliged to provide the purchased service on the specified dates and in accordance with the reservation details.

In cases where the performance of the service becomes impossible due to weather and sea conditions, force majeure events, or restrictions imposed by official authorities, cancellation, postponement, or alternative solutions shall be evaluated within the framework of the Cancellation & Refund Policy.

PROTECTION OF PERSONAL DATA

Personal data belonging to the Buyer are processed in accordance with the Law No. 6698 on the Protection of Personal Data and the Seller’s KVKK Disclosure Notice and Privacy Policy.

ELECTRONIC APPROVAL

The Buyer declares that they have read and understood this Agreement and all related pre-information texts in electronic form, and that by completing the payment, they accept all provisions herein.
