Cancellation Refund Policy

This Cancellation & Refund Policy has been prepared to explain the cancellation, refund, and modification conditions applicable to boat rental / yacht charter services provided by Buenoways Yatçılık Turizm San. ve Tic. Ltd. Şti. (“Buenoways”). This policy constitutes an integral part of the Distance Sales Agreement.

1. SCOPE

This Cancellation & Refund Policy applies to all online reservations, advance payments (deposits), full payments, and transactions carried out through electronic payment systems via the Buenoways website.

2. INFORMATION ON THE RIGHT OF WITHDRAWAL

Pursuant to Law No. 6502 on the Protection of Consumers and Article 15 of the Regulation on Distance Contracts;

For services that must be provided on a specific date or during a specific period, including accommodation, transportation, vehicle rental, and services related to the use of leisure time, the consumer does not have a right of withdrawal.

Since boat rental and yacht charter services are date-specific and reservation-based services, they are excluded from the scope of the 14-day right of withdrawal.

3. CANCELLATION CONDITIONS

In the event that the Buyer requests to cancel the reservation, the following conditions shall apply:

– Cancellations made at least 180 days prior to the charter start date: 80% of the amount paid shall be refunded.

– Cancellations made between 179 and 91 days prior to the charter start date: 50% of the amount paid shall be refunded.

– Cancellations made 90 days or less prior to the charter start date: no refund shall be made.

For reservations secured with a deposit (advance payment), the deposit shall be non-refundable unless otherwise explicitly stated.

4. FORCE MAJEURE

In the event that the performance of the service becomes impossible due to circumstances beyond the control of the parties, including but not limited to adverse weather and sea conditions, natural disasters, war, strikes, epidemics, or restrictions imposed by official authorities;

– The reservation may be postponed to a later date,

– Suitable alternatives may be offered,

– Refund conditions shall be evaluated on a case-by-case basis.

Such evaluation shall be carried out in good faith between the parties.

5. MODIFICATION REQUESTS

Requests by the Buyer for changes regarding dates, yacht selection, or service scope shall be evaluated subject to availability. Modification requests may result in additional charges or price differences.

6. REFUND PROCESS

Approved refunds shall be processed using the same payment method used for the original transaction.

– Credit card refunds may take 7–14 business days to be reflected in the account, depending on the bank.

– Buenoways shall not be held responsible for delays caused by banks or payment service providers.

7. ELECTRONIC ACCEPTANCE

The Buyer declares that they have read, understood, and accepted this Cancellation & Refund Policy prior to completing the reservation and payment process.

8. EFFECTIVE DATE

This Cancellation & Refund Policy shall enter into force as of the date it is published on the Buenoways website. Buenoways reserves the right to amend this policy when deemed necessary.
